Before completing the Crazy9 booking form please ensure you have read our booking terms and conditions located below this form. You should read our privacy policy, our course rules and also checked with the venue to make sure they have the necessary ground requirements. You will not be able to make a booking unless you agree to them all. If you’ve not already done so, please check with us FIRST (using the Check Availability form) to make sure we are available for your event date. It’s also worth noting that if you’ve left it a few days between checking for availability and filling out this form, you must check again as we can not guarantee that the date will still be available.


    Note: The start time usually coincides with the start of the Drinks Reception. We provide entertainment for up to six hours and close/pack up the course no later than 20:00

    Please note: a 3.4% + 20p service charge will be added to the booking fee and final payment invoices to cover Payment Gateway fees.

    Booking Terms & Conditions

    1.0 Summary

    1.1 We always do our best to fulfil your needs and meet your expectations, but it is important to have things written down so that we all know what’s what, who should do what and when, and what will happen if something goes wrong. In this contract you won’t find any complicated legal terms or long passages of unreadable text. We’ve no desire to trick you into legally agreeing to something that you might later regret. What we do want is what’s best for both parties, now and in the future.

    2.0 Definitions

    2.1 The “Client” is the person, firm, corporate or public body hiring the Services, referred to as “you” or “your”.

    2.2 The “Company” is Crazy9 Ltd, referred to as “Crazy9”, “we”, “us” or “our”.

    2.3 The “Service” is the mobile crazy golf course and associated equipment and extras provided by Crazy9.

    2.4 The “Terms” means these Booking Terms and Conditions.

    2.5 “Winter Season” is mid-September to mid-April.

    2.6 The “Venue” is the location where the Service is to be provided and any authorised representative of that location.

    3.0 Contract Formation and General Terms

    3.1 A Contract is formed when the Booking Form is submitted and the Booking Fee is paid.

    3.2 By making a booking, the Client agrees to these Terms in full.

    3.3 It is the Client’s responsibility to ensure all relevant parties are aware of and comply with these Terms.

    3.4 No variation to these Terms is valid unless agreed in writing by Crazy9.

    3.5 This Contract is governed by the laws of England and Wales.

    3.6 The courts of England and Wales shall have jurisdiction over any dispute arising under or in connection with this Contract.

    3.7 Crazy9 may make reasonable changes to the Service where required for operational reasons.

    3.8 In the event of any conflict, overlap, or inconsistency between sections of this Contract, the order of precedence shall be as follows:

    1. Section 5.0 (Cancellations) shall take priority over all other sections;
    2. Section 7.0 (Postponements) shall take priority over Sections 8.0 and 9.0 where a postponement or cancellation scenario is involved;
    3. Section 6.0 (Force Majeure) shall apply only where an event is clearly identified as Force Majeure and shall override Sections 5.0, 7.0, 8.0 and 9.0 only where expressly applicable;
    4. Sections 8.0 (Venue Changes) and 9.0 (Weather and Site Conditions) shall be subject to Sections 5.0 and 7.0 in all cases involving cancellation or postponement outcomes.

    4.0 Booking Fee and Payments

    4.1 A non-refundable Booking Fee of £250 is payable within 48 hours of booking. If not received, the booking date may be released.

    4.2 Full payment is due at least 60 days before the event date. The Booking Fee is deducted from the final balance.

    4.3 Payments may be made by bank transfer or card. Processing fees may apply.

    5.0 Cancellations

    5.1 The Client may cancel within 30 days of booking and receive a full refund of payments made.

    5.2 After 30 days from booking, cancellations are subject to the following terms.

    5.3 If cancellation occurs more than 120 days before the event date, only the Booking Fee is retained.

    5.4 If cancellation occurs between 120 and 91 days before the event date, 50% of the total agreed fee is payable.

    5.5 If cancellation occurs between 90 and 61 days before the event date, 75% of the total agreed fee is payable.

    5.6 If cancellation occurs within 60 days of the event date, 100% of the total agreed fee is payable.

    5.7 All payments already made shall be offset against any cancellation charges due. Any balance owed shall be payable by the Client and any excess will be refunded.

    5.8 Cancellation is deemed effective on the date written notice is received by Crazy9, regardless of any subsequent discussions or negotiations regarding postponement or alternative dates

    5.9 Where a postponement has been requested prior to cancellation, cancellation is deemed effective from the date the postponement request was first received, unless a new date has been agreed in writing.

    5.10 Refunds will be processed within 14 days where applicable.

    5.11 If Crazy9 is unable to provide the Service for reasons other than Force Majeure, all monies paid will be refunded and no further liability will exist.

    6.0 Force Majeure

    6.1 Neither party shall be liable for failure to perform due to circumstances beyond reasonable control.

    6.2 This includes (but is not limited to): extreme weather, natural disasters, war, terrorism, epidemic, government restrictions, strikes, road closures preventing access, or serious transport disruption.

    6.3 Where Force Majeure prevents the event, Crazy9 will first attempt to reschedule the event.

    6.4 If rescheduling is not possible, any monies paid will be refunded less any non-recoverable costs already incurred in preparation for the event.

    7.0 Postponements

    7.1 All postponement requests must be made in writing.

    7.2 A postponement does not constitute cancellation. The original booking remains active until a new date is confirmed in writing.

    7.3 One postponement may be permitted without charge provided:

    (a) it is requested more than 120 days before the event date; and

    (b) Crazy9 is available on the new date.

    7.4 Any subsequent postponement requests may be subject to an administration fee at Crazy9’s discretion and may also be subject to repricing at current rates.

    7.5 All monies paid will be transferred to the new date once confirmed.

    7.6 Where the event is moved to a different calendar year, pricing will be adjusted to Crazy9’s rates applicable at the time of the new date.

    7.7 All postponements are subject to availability.

    7.8 If no suitable new date is agreed, the Client may retain the original date or cancel under Section 5.0.

    7.9 If the Client requests postponement but does not provide a proposed new date within 30 days, Crazy9 may treat the booking as cancelled. Cancellation will be deemed effective from the date the postponement request was first received.

    7.10 Any postponement request received within 120 days of the event date will be treated as a cancellation unless otherwise agreed in writing.

    8.0 Venue Changes

    8.1 Venue changes are permitted subject to suitability, distance, access, and operational requirements.

    8.2 Additional travel or setup costs may apply where the new venue increases operational requirements.

    8.3 If the Client requests a change of venue and the proposed new venue does not meet Crazy9’s reasonable requirements for safe, practical or viable setup and operation of the Service, the request to change venue shall be deemed a cancellation initiated by the Client and shall be subject to the cancellation terms set out in Section 5.0.

    8.4 Where a venue change is not possible due to access, space, ground conditions, or operational limitations at the proposed new venue, and no suitable alternative venue is agreed, the booking shall remain at the original venue unless the Client chooses to cancel in accordance with Section 5.0.

    8.5 Any venue change is subject to Crazy9’s approval and confirmation in writing.

    8.6 Where a venue change is approved, the booking shall continue under the revised venue details and all applicable terms shall remain in force.

    9.0 Weather and Site Conditions

    9.1 The Client is responsible for ensuring that the Venue provides suitable ground conditions for the safe installation and operation of the Service, unless an indoor alternative has been agreed in writing.

    9.2 Where weather conditions require additional protection, Crazy9 may require the use of protective coverings or equipment to ensure safe operation of the Service.

    9.3 If, on arrival or during setup, Crazy9 determines that weather conditions, ground conditions, or site conditions make it unsafe, impractical, or impossible to install or operate the Service, Crazy9 shall be entitled to suspend or refuse setup.

    9.4 Where setup or operation cannot proceed due to weather or site conditions, and no suitable alternative indoor or covered arrangement is available, the booking shall be deemed cancelled by the Client and shall be subject to the cancellation terms set out in Section 5.0.

    9.5 If the Venue refuses permission to install or operate the Service due to weather or site conditions, this shall also be treated as a cancellation by the Client under Section 5.0.

    9.6 Crazy9 shall not be liable for failure to operate the Service where conditions are beyond reasonable operational control.

    9.7 Where gazebos or protective coverings are required under this Section 9.0, the Client agrees that any associated hire or supply costs shall be payable in accordance with the booking confirmation and/or booking form agreed at the time of booking.

    10.0 Health and Safety

    10.1 Crazy9 reserves the right to refuse admittance to the course or to remove a participant from the course should it be deemed necessary to do so. This includes a participant who does not comply with the course safety rules or who is deemed to be under the influence of alcohol or drugs.

    10.2 We shall be entitled to prevent any person from undertaking or completing the course if we deem the behaviour of any participant unsuitable.

    10.3 Where the event may include guests under the age of 16 years, the client (or parent/guardian) is responsible for the behaviour and safety of any minors attending The Venue. The Client will provide and maintain adequate adult supervision for guests under the age of 16 years at all times, and we will not be liable for the supervision of minors. The course is not suitable for infants and therefore they will not be allowed to play or be within the course area (for their own safety).

    10.4 Unwarranted abuse or threatening behaviour from The Client’s guests, The Venue management and/or The Venue staff will not be tolerated and will result in the activities being terminated with immediate effect with no loss to Crazy9.

    10.5 Children always remain the responsibility of the adults who accompanies them.

    10.6 A hard copy of our Health And Safety Report and our Risk Assessment document will be present at the event and a copy can be sent to you via email if requested.

    11.0 Equality Policy

    11.1 We aim to abide by and promote equality legislation. We follow both the letter and the spirit of the law in this area. We try to avoid unjustified discrimination which we recognise is a barrier to equality, diversity, inclusion and human rights.

    11.2 Any person making discriminatory remarks will not be allowed to play or will be asked to leave.

    11.3 A hard copy of our Equality Policy document will be present at the event and a copy can be sent to you via email if requested.

    12.0 Insurance

    12.1 Crazy9 agrees to provide proof of Public Liability Insurance and all necessary certifications as required by The Venue.

    13.0 Damages & Loss

    13.1 We do not accept liability due to damage or loss of either the player’s or the venue’s personal possessions or personal injury whilst playing the mobile adventure course, you play at your own risk.

    13.2 It is to be expected that our course will receive minor scuffs and dings during the event however you agree that compensation for any loss of or damage to Crazy9’s equipment, vehicle(s) and/or personal belongings caused by deliberate or malicious behaviour of your guests, venue customers and/or venue staff may be sought, including any additional costs.

    14.0 Marketing

    14.1 From time to time we take pictures and videos during the event. By taking part in these activities, you are giving us your permission to use any pictures of yourself and anybody in your party for possible use in Crazy9 promotion and marketing. We will never sell these pictures and only use them exclusively for our own use. If you object to us using images of you or your party then please inform us in writing when making your booking.

    15.0 Ground Requirements

    15.1 It is your responsibility prior to making the booking that the venue has an area or areas where the crazy golf course can be set up as detailed on the ‘Ground Requirements’ Page on the Crazy9 website. Crazy9 will not be held responsible for being unable to set up the course should the venue not have the required space or floor type.

    16.0 Venue Location, Access and Setup/dismantling times

    16.1 Prices shown on the website and those quoted at time of booking are based on the venue being within a 35 mile radius of Stockport. A sliding scale fuel & labour surcharge will be added to the booking fee to cover any additional travel outside of the 35 mile radius.

    16.2 The Client will appreciate that suitable time before and after the event is required to set up and dismantle the course from the venue. Therefore, The Client and The Venue will allow suitable time for the installation and dismantling and removal of equipment (up to 2 hours each side of the booking times, 4 hours if pop-up gazebos are required or other amount if previously agreed).

    16.3 Crazy9 shall not be liable for any additional charges incurred to The Client by The Venue in relation to the additional time taken to setup and dismantle the course.

    16.4 Vehicle access: Our course will arrive at the venue in a transit van, the client is responsible for ensuring that access and suitable parking facilities are made available. Where The Venue does not have its own parking facilities, Crazy9 reserves the right to pass on any additional parking fees for refund by The Client.

    16.5 Late Arrival: Crazy 9 will not be held liable for late arrival at the venue due to Force Majeure (see 6.0)

    17.0 Privacy Policy

    17.1 We will use the personal information you provide to us:

    • in accordance with our Privacy Policy
    • to supply the activities to your event
    • to process your payments
    • to communicate with you to arrange the event
    • to get feedback from you after the event.

    18.0 Course Rules

    There is to be no more than 4 people in a group on any one hole

    The holes must be played in sequential order. Hole jumping is not permitted

    When putting do not swing the putter higher than knee height

    One metre distance must be maintained between players during putting

    There is a 6 shot limit per hole, so once you get to 6 shots, move on to the next hole

    If the ball goes off the course, replace the ball where it went off with a one stroke penalty.

    If the ball ends up against an edge or obstacle it may be moved one club head length out.

    Many of our holes contain moving parts such as (but not limited to) the church bell, the rotating hole and the bee hive bees. Do not touch or stand on any of these moving parts and ensure that children are kept under supervision as this may result in personal injury and or damage to the course of which the player or parent/guardian is responsible for.

    Players are only allowed to stand on the teeing off grass and on the grass adjacent to the holes. Do not walk on any other part of the course.

    Crazy9 Mobile Crazy Golf is a game of putting and all players, particularly children should refrain from hitting the ball excessively hard, thereby causing a hazard to themselves and other people.

    Crazy9 Mobile Crazy Golf reserves the right to remove clubs and balls from any player behaving unacceptably and request that they leave the site.

    19.0 Phew, we’re almost done! but where’s all the horrible small print? (General Legal Terms)

    19.1 Just like a parking ticket, you can’t transfer this contract to anyone else without our permission.

    19.2 Crazy9 may transfer its rights and obligations under this Contract where reasonable.

    19.3 No third party shall have rights to enforce this Contract under the Contracts (Rights of Third Parties) Act 1999.

    19.4 If for some reason one part of this contract becomes invalid or unenforceable, the remaining parts of it remain in place.

    19.5 Although the language is simple, the intentions are serious and this contract is a legal document. This Contract is governed by the laws of England and Wales.

    19.6 The courts of England and Wales shall have jurisdiction over any dispute arising under or in connection with this Contract.

    Execution

    By completing the Booking Form and paying the Booking Fee, the Client confirms acceptance of these Terms and enters into a legally binding Contract with Crazy9.
